In protest against the extension of his detention
” Tostari” is fighting the second round of the Empty Bowl battle
The former “Al-Nidal” media official, Yaqoub Hor Al-Tostari, announced that he is fighting the second round of the Empty Bowl battle to protest the extension of his detention in Denmark.
Yaqoub Hor Tostari, the spokesman for the Arab Struggle Movement for the Liberation of Ahwaz, was arrested in early February of this year (03.02.2020) in Denmark.
This coincided with the arrest of Habib Jabor, the movement’s leader, and his brother Nasser Jabor, while the Dutch security forces arrested the journalist Isa Sawari (Mehdi Fakher), a member of the media office and presenter of a TV program on the Ahwazna channel.
According to human rights and legal sources, the ” Tostari” hunger strike comes as an escalating step for the court continuous extension of his detention without providing evidence to prove the accusations against him.
The sources confirmed that the accusations directed against the members of the Arab Struggle Movement are false, fabricated and unfounded accusations so that the Danish authorities for six months were unable to provide evidence that would warrant their continued detention.
For its part, the family of Yaqoub Hurr Tostari called for support for the battle he is waging for a fundamentally just cause, stressing that he did not violate legitimate and legal methods through his struggle and defence of the rights of the Ahwazi people
The family demanded the Special Rapporteur on the independence of judges and lawyers at the United Nations, the Special Rapporteur on the rights of refugees, and the Danish government headed by the Prime Minister of Denmark, to urgently and immediately intervene to release Yaqoub Hor Tostari, especially as he spent the legal period of detention without proving any evidence of the accusations against him. He repeatedly denied it and investigated the pressure put forth by the Iranian authorities to extend his detention.
The family stressed the need to activate effective solidarity with the cause of Yaqoub Hurr and his companions, especially from institutions concerned with human rights, chiefly: Amnesty International, Council of Europe (Le Conseil de l’Europe), Foundation for Human Rights Defenders (ProtectDefenders), Front Line Foundation for the Protection of Defenders On human rights (frontlinedefenders), and the Danish Refugee Council (DRC).
In a related matter, the Ahwazi Organization for the Defence of Human Rights confirms that the measures taken by the Danish authorities, whether in the manner of arrest or detention, violate what is stipulated in international conventions, as follows:
First: the principle of the presumption of innocence, which is the most important principle in dealing with prisoners awaiting trial. They were not put in prison to punish them, and the prison authorities must take this into account, in compliance with Article (11) of the Universal Declaration of Human Rights, which states: Every person accused of a crime is considered innocent until proven guilty by law in a public trial in which he has the necessary guarantees for his defence.
Second: The judicial process against Yaqoub Hor Tostari took a slow grant and extended his detention without evidence in violation of Article (9) of the International Covenant on Civil and Political Rights, which states: The arrested or detained on a criminal charge shall be brought promptly to a judge or official legally authorized directly to judicial functions and be He has the right to be tried within a reasonable time or released. The detention of persons awaiting trial may not be the general rule. However, their release may be suspended on guarantees to ensure that they will attend the trial at any other stage of the judicial process and to ensure that the sentence is organized when necessary.
